11/19/2013 Effective December 1, 2013, amended Fed. R. Bankr. P. 1007(b)(7) will give an individual debtor the option of having an approved personal financial management course provider notify the court directly that the debtor has completed a post-petition instructional course concerning personal financial management. To directly notify a bankruptcy court of a debtor’s course completion, an approved course provider will file a personal financial management course certificate with the court. Approved course providers will need to register as CM/ECF limited filers in each bankruptcy court where they are filing certificates.

9/30/2013 Beginning October 1, 2013, a new Online Master Address List program will assist debtors not represented by an attorney, or whose petitions are prepared by a Bankruptcy Petition Preparer with preparing a Master Address List for paper submission in the correct format.  The program is available through a link under the Information for Debtors heading on the court's website homepage at www.caeb.uscourts.gov.

The
Guidelines for Preparation of Master Address Lists have been revised to include the new online program information and to remove information regarding diskettes, CD Roms and additions of creditors to master address lists already filed with the Clerk's office.  Information regarding additions of creditors to master address lists already filed with the Clerk's office is available through a link under the Court Information heading on the courts' website homepage at www. caeb.uscourts.gov.

The
Verification of Master Address List has been revised to remove the 'specific format' check boxes.

Both EDC Form 2-190, Guidelines for Preparation of Master Address Lists, and EDC Form 2-100, Verification of Master Address List, have been posted on the court's website and are effective October 1, 2013.
9/25/2013 The U.S. Marshal service has informed the bankruptcy court that temporary staffing vacancies preclude adequate security for the Bakersfield Bankruptcy Court.  The situation is likely to persist for several months. Effective immediately, all Bakersfield bankruptcy matters will be heard in the Bakersfield Federal Courthouse, 510 19th Street, Bakersfield, California or in the Fresno U.S. Bankruptcy Court.  Please consult the posted calendar or the pre-hearing disposition calendar to determine where the hearings for that day will be held.

This will enable quicker and more direct access to the 341 meeting calendars without the need for a PACER account. The information is updated daily.

Notice of Changes to Administrative Order Regarding Electronic Filing in BAP Cases:


The BAP modified its Administrative Order Regarding Electronic Filing in BAP Cases to require registration with the BAP’s CM/ECF system for all attorneys appearing, participating, or wanting to receive notices in appeals before the BAP. The BAP also modified the Administrative Order to increase the maximum size for a single electronic filing, including attachments, to 50 megabytes. See Rule 1(a) and Rule 7(d) of the Administrative Order which is available on the BAP website: www.ca9.uscourts.gov/bap under “Electronic Case Files (ECF)”.

ELECTRONIC PUBLIC ACCESS (EPA) FEE SCHEDULE CHANGE


At its March 12, 2013 session, the Judicial Conference amended the Electronic Access Fee (EPA) Fee Schedule.  The fee schedule was revised to (a) make format and style changes; (b) clarify the principles underlying the exemption policy; (c) clarify that attorneys of record and parties in a case (including pro se litigants) may receive one free electronic copy of all documents filed electronically via the notice of electronic filing (or notice of docket activity); and (d) clarify that non-case specific reports are not subject to the 30-page fee cap.

3/20/2013 AUTOMATIC ADJUSTMENT OF CERTAIN DOLLAR AMOUNTS IN THE BANKRUPTCY CODE AND FORMS

On April 1, 2013, automatic adjustments will be made to the dollar amounts stated in various provisions of the Bankruptcy Code and one provision in Title 28 of the United States Code.  The adjustments will apply to cases filed on or after April 1, 2013 and will affect, among other things, eligibility of a debtor to file under chapters 12 and 13 of the Bankruptcy Code, certain maximum values of property that a debtor may claim as exempt, the maximum amount of certain claims entitled to priority, the calculation of the “means test” for chapter 7 debtors, the duration of a chapter 13 plan, the definition of a small business debtor, the minimum aggregate value of claims needed to commence an involuntary bankruptcy, the value of “luxury goods and services” deemed to be nondischargeable, and where the trustee may commence certain proceedings to recover a money judgment or property.

In addition, Official Bankruptcy Forms and Director's Forms containing references to affected dollar amounts will be amended effective April 1, 2013. The amended forms will apply to cases filed on or after that date and will include:  Official Form 1,
Voluntary Petition (1 change on page 1); Official Form 6C, Schedule of Property Claimed as Exempt (1 change on page1); Official Form 6E, Schedule of Creditors Holding Claims Entitled to Priority (1 change on page 1 and 2 changes on page 2); Official Form 7, Statement of Financial Affairs (1 change on page 2); Official Form 10, Proof of Claim (2 changes in box 5); Official Form 22A, Statement of Current Monthly Income and Means Test Calculation (Chapter 7) (1 change to line 38 and 4 changes to line 52); Official Form 22C, Statement of Current Monthly Income and Calculation of Commitment Period and Disposable Income (Chapter 13) (1 change to line 43); Director's Form B200, Required Lists, Schedules, Statements and Fees (1 change on page 2, 1 on page 3 and 1 on page 4); and Director's Form B283, Chapter 13 Debtor's Certifications Regarding Domestic Support Obligations and Section 522(q) (2 changes on page 1).
