ATTENTION PRO SE DEBTORS AND OTHER UNREPRESENTED PARTIES

During the course of a bankruptcy case or proceeding, bankruptcy court notices are mailed by the Bankruptcy Noticing Center (BNC) on behalf of the court.  The BNC, which is operated by a private contractor, provides notice production and mailing services for the court, but THE BNC IS NOT THE COURT.

DO NOT SEND DOCUMENTS TO THE BNC.

Documents related to a bankruptcy case or proceeding should be sent directly to the court.
12/3/2012 Form EDC 2-020, Application to Pay Filing Fee in Installments, has been revised to remove the debtor's proposed terms of payment.  Instead, the Clerk will order that one-quarter of the total filing fee be paid to the court at 30, 60, 90, and 120 days after the filing of the petition.  The dollar amount and due date of each payment will be stated in the Order Approving Payment of Filing Fee In Installments, Form EDC 2-021, prepared by the Clerk and returned to the debtor. 

Please destroy all previous versions of EDC 2-020 and begin using the revised form effective immediately. Revised EDC 2-020 is posted on the Forms and Publications page of this web site, or click here.
11/30/2012 New CAEB RSS Feeds Now Available

Due to popular request, the U.S. Bankruptcy Court for the Eastern District would like to announce our new Pre Hearing Disposition RSS feeds. The purpose of the feed is to immediately inform its subscribed users when a new pre hearing disposition has been published. You have the option of subscribing to a feed for an individual judge as well as subscribing by location.

Prior to subscribing to a RSS feed, you must have the ability to read its contents. Most email clients (Outlook, Lotus Notes, etc.) and internet browsers have RSS reading capabilities. There are also numerous free smart phone apps which are specifically designed to read RSS feeds.

9/27/2012 UPDATED CENSUS BUREAU MEDIAN FAMILY INCOME DATA

On October 12, 2012, the U.S. Trustee Program will post updated Census Bureau State Median Family income data at http://www.justice.gov/ust/eo/bapcpa/meanstesting.htm.  The updated data will be applied to petitions filed on or after November 1, 2012.
9/25/2012 FEE INCREASES EFFECTIVE NOVEMBER 21, 2012

The following fees are effective November 21, 2012:

Total fee to file a case under Chapter 11, Chapter 9, or Chapter 15:                          $1,213    
Fee to convert a Chapter 7 case to Chapter 11:                                                            $922  
Fee to convert a Chapter 13 case to Chapter 11:                                                          $932    
Fee for reopening a Chapter 11 case:                                                                         $1,167   
Total fee for splitting a joint Chapter 11 case:                                                              $1,213

9/25/2012 CENTRALIZED PROCESSING OF RETURNED BNC MAIL

The Judiciary's Bankruptcy Noticing Center (BNC) contractor will begin accepting, processing and securely disposing of notices that would otherwise be returned to the bankruptcy court by the United States Postal Service (USPS).  The service will provide timely notification to debtors' attorneys of returned notices.  For additional information, click here.
9/24/2012 Electronic Public Access Fee Increases Effective October 1, 2012

At its September 11, 2012 session, the Judicial Conference of the United States approved the following amendments to the Electronic Public Access Fee Schedule effective October 1, 2012:
        Item III -- For every search of court records conducted by the PACER Service Center, the fee will increase from $26 to $30; and
        Item V -- For every check paid to the PACER Service Center that is returned for lack of funds, the fee will increase from $45 to $53.
8/29/2012 FILED STAMPS ON ELECTRONICALLY FILED DOCUMENTS

Beginning mid-afternoon on Friday, August 31, 2012, electronically filed documents will no longer be FILED stamped.  Instead, a header containing the case number and the 'filed' date will be placed on the first page of the document at the top.  Both the FILED stamp and the header will still appear on documents electronically filed before mid-afternoon Friday.   
8/24/2012 ATTENTION E-FILERS -- FOUR DOCUMENTS ADDED TO SINGLE FILE UPLOAD

Four documents have been added to the e-filing system's Single File Upload. They are:

-Application for Continuance (added to Filing Type Motions/Responses/Objections/Orders)
-Proposed Order Continuing Hearing (added to Filing Type Motions/Responses/Objections/Orders as a Sub-Type of Document Type For Judge's or Deputy Clerk's Signature)
-Certificate of Chapter 13 Debtor Regarding 11 U.S.C. Section 522(q) Exemptions (added to Filing Type Miscellaneous Documents (Other) )
-Debtor's 11 U.S.C. Section 1328 Certificate (added to Filing Type Miscellaneous Documents (Other)).

8/21/2012 PROPOSED AMENDMENTS PUBLISHED FOR PUBLIC COMMENT

The Judicial Conference Advisory Committees on Appellate, Bankruptcy, Criminal, and Evidence Rules have proposed amendments to their respective rules and requested that the proposals be circulated to the bench, bar, and public for comment.  The proposed amendments and an email link for submitting comments is posted on the Judiciary's web site. The public comment period ends February 15, 2013.

6/26/2012 Application for the Cornelius Blackshear Presidential Fellowship

The National Conference of Bankruptcy Judges is delighted to bestow on the Honorable Cornelius Blackshear, a dear friend and esteemed colleague, the distinction of naming their minority fellowship program, the Honorable Cornelius Blackshear Fellowship Program. This program will provide an annual stipend/scholarship for up to five minority attorneys to attend its annual meeting each year.

NCBJ Blackshear Fellows will receive a copy of this proclamation, along with their stipend/scholarship, to remind them of the illustriousness Judge Blackshear brought to the U.S. Bankruptcy Court bench as he distinguished himself by his renowned scholarship and development of bankruptcy jurisprudence.

6/19/2012 Judge Clement has amended his July- August selfset calendar. Hearings already set on 8/8 and 8/9 will be heard as scheduled. No further hearings shall be set for these dates. 8/15 and 8/16 have been added as hearing dates for Fresno matters.

Reminder Concerning Electronic Public Access (PACER) Fee Increase

In September 2011, the Judicial Conference of the United States authorized an increase in the Judiciary's electronic public access (PACER) fee from $.08 per page to $.10 per page. The fee increase will take effect on April 1. 2012.

Amendments to Local Bankruptcy Rules Effective  May 1, 2012

2/22/2012 Effective immediately, the United States Bankruptcy Court, Eastern District of California, has implemented a new, toll-free phone number for the e-Filing Help Desk.  The new number, 1-855-542-0992, will replace the current toll-free phone number of 1-877-875-7823.  Help Desk hours will remain between 9 a.m. and 4 p.m., Monday through Friday, excluding holidays.  Only calls related to electronic filing will be returned.
1/19/2012 Court Adopts Delegation of Authority to the Clerk of the Bankruptcy Court and his Deputies
1/11/2012 On the following dates, the U.S. Bankruptcy Court will be performing an upgrade to the CM/ECF software. During this time, you will NOT be able to obtain electronic case information and imaged documents through PACER, view "free look" documents, or submit documents for filing electronically through the e-Filing system.
