2/9/2024 Updated Procedures for Zoom.gov Hearing Registrations and Public Access Guidelines Effective February 20, 2024

Current Procedure for Zoom.gov Hearings: Participants in court hearings who wish to appear via Zoom.gov can find instructions, along with the zoom link and meeting information, on the Pre-Hearing Disposition page of our website. Registration to appear at a hearing via Zoom.gov can be done with minimal advance notice.

New Procedure Starting February 20, 2024: Individuals who wish to participate in hearings via Zoom.gov must register by 4:00 p.m. one business day before the scheduled hearing. Information for accessing the Zoom.gov hearing will no longer be available on the Pre-Hearing Disposition page. Instead, it will be sent via email to those who have registered, after 4:30 p.m. on the business day preceding the hearing. To learn how to register for a Zoom.gov hearing, click here.

Access for Public and Media: The public, and media are allowed to register for audio-only access to non-evidentiary hearings and proceedings in the bankruptcy court. There is no video access permitted for evidentiary hearings or trials. This does not restrict the public or media from attending hearings in person. Audio recordings of the proceedings will be available for download on PACER.

12/13/2023 In alignment with directives from the Administrative Office to reduce costs, our court will be modifying its current mailing procedures for the Chapter 13 Trustee’s Final Report and Account. Effective January 1, 2024, the Clerk’s Office will cease mailing the Chapter 13 Final Report and Account to parties in the case. We will continue to send the Notice of the Chapter 13's Final Report and Account, which will include the date by which objections must be submitted. Additionally, the Notice will guide recipients on how to access the Final Report and Account in our offices and via the PACER system.

11/29/2021 USTP to Post Updated UST Form 11-MORs and UST Form 11-PCRs

On June 21, 2021, the United States Trustee Program’s rule entitled Uniform Periodic Reports in Cases Filed Under Chapter 11 of Title 11, published at 28 C.F.R. § 58.8 (the “Final Rule”) became effective. The Final Rule requires that chapter 11 debtors-in-possession and trustees, other than in small business and subchapter V cases, file monthly operating reports and post-confirmation reports using streamlined, data-embedded, uniform forms in every judicial district where the U.S. Trustee Program operates.

On November 30, 2021, the United States Trustee Program will post on its website updated versions of the UST Form 11-MOR, Monthly Operating Reports (“MOR”) and UST Form 11-PCR, Post-confirmation Reports (“PCR”), that should be used for all reports filed after that date.1 Designed to improve the overall user experience, the updates will streamline the process of embedding data on the forms by using standard PDF bar-code technology. The updates do not impact the information required to be reported on the MORs and PCRs.

While at that webpage, please subscribe to the “Chapter 11 Operating Reports E-mail Updates” feature to automatically receive future email updates about the forms and periodic reporting under the Final Rule.

9/20/2021 Effective December 1, 2021, the Director of the Administrative Office of the United States Courts has designated any entity that receives 100 or more paper bankruptcy notices in a single calendar month as a high-volume paper notice recipient pursuant to Fed. R. Bankr. P. 9036(b)(2)(B) (as amended effective December 1, 2021) (the “Rule”). The threshold number of paper notices that will cause a notice recipient to be designated as a high-volume paper notice recipient pursuant to the Rule will be reviewed annually and may be adjusted once a year, effective on December 1st of each year. Once the threshold paper notice amount is reached, the Bankruptcy Noticing Center (BNC) will notify the notice recipient that it must register for Electronic Bankruptcy Noticing (EBN) or that, if the recipient does not register within 45 days of the date of the notification, the BNC will establish an electronic address where the Director designates the recipient to receive its notices pursuant to the Rule.

6/23/2020 The Bankruptcy Court of the Eastern District of California welcomes Jennifer E. Niemann as its newest bankruptcy judge.  Judge Niemann will serve her fourteen year term in Fresno, California and preside in bankruptcy cases in Bakersfield, California.  Judge Niemann was appointed on June 16, 2020.  Prior to her appointment, Judge Niemann was in private practice and represented Chapter 11 debtors, Chapter 11 trustees and creditors in bankruptcy cases and out-of-court restructurings.  Judge Niemann also served as a long-term judicial law clerk to three different bankruptcy judges of the U.S. Bankruptcy Court for the Northern District of California.  Judge Niemann received her bachelor’s degree, summa cum laude, from the University of Illinois at Urbana-Champaign and her J.D. from Harvard Law School.

In light of quickly evolving circumstances and to ensure physical safety, Chief Judge Kimberly J. Mueller has ordered all U.S. Courthouses in the Eastern District of California closed to all tomorrow, Monday, June 1.  Since Department A has a digital record that cannot be operated without a live person in the courtroom, the court is unable to provide a record of hearings on Monday, June 1.  As a result, on its own motion the court is continuing all hearings noticed for June 1 to June 8 at the same time.  The court will be issuing a notice of continuance.
